Obscenity is not protected under First Amendment rights to free speech, and violations of federal obscenity laws are criminal offenses. The U.S. courts use a three-pronged test, commonly referred to as the Miller test, to determine if given material is obscene. Obscenity is defined as anything that fits the criteria of the Miller test, which may include, for example, visual depictions, spoken words, or written text. Federal law makes it illegal to distribute, transport, sell, ship, mail, produce with intent to distribute or sell, or engage in a business of selling or transferring obscene matter. Convicted offenders face fines and imprisonment. Although the law generally does not criminalize the private possession of obscene matter, the act of receiving such matter could violate federal laws prohibiting the use of the mails, common carriers, or interactive computer services for the purpose of transportation. And -- similar to Ted Lasso's -- the movie's overall messages of kindness, nonviolence, and free choice are always refreshing.
In May 2016, the image macro shown above began circulating on Facebook, holding that back in 1975 a young Hillary Clinton (then Hillary Rodham) had "volunteered" to represent a 42-year-old man (Thomas Alfred Taylor) who was accused of raping a 12-year-old girl, that Clinton told the judge in the case that the complainant "made up the rape story because [she] enjoyed fantasizing about older men, that Clinton "got [the] rapist freed," and that Clinton later admitted she knew the defendant was guilty and "laughed about" the outcome of the case. Although Hillary Clinton was indeed involved in a case of this nature, the aspects of the case presented in the image were largely inaccurate or exaggerated.
Finally, Hillary didn't "free" the defendant in the case. Instead, the prosecuting attorney agreed to a plea deal involving a lesser charge that carried a five-year sentence, of which the judge suspended four years and allowed two months credit of time already served towards the remaining year:
Pedobear is an Internet meme that became popular through the imageboard 4chan.[1] As the name suggests ("pedo" being short for "pedophile"), it is portrayed as a pedophilic cartoon bear.[2] It is a concept used to mock child sex offenders or people who have any sexual interest in children or "jailbait".[3][4] The bear image has been likened to bait used to lure children or as a mascot for pedophiles.[3]
The bear character originates from the popular textboard website 2channel in Japan, where it was introduced, in the form of Shift_JIS art, as クマー (Kumā), an interjection of the word 熊 (Kuma) meaning bear in Japanese. Unlike Pedobear, Kumā has no sexual connotations, pedophilic or otherwise.
Pedobear eventually became known outside 4chan as it was referenced by newspapers and prominent websites. In the media it was frequently claimed to be a mascot of child sex offenders, which is contested by meme catalogs who note that its intent is actually to mock pedophiles.[5][6]
In September 2010 cosplay participants dressed as the character were accused of being potential child sex offenders,[12] after the San Luis Obispo County Sheriff's Department issued a warning that Pedobear was a sign of the presence of pedophiles and other people with inappropriate sexual behavior, and suggested that Pedobear was a kind of mascot among pedophiles.[3][13] Law enforcement officials in San Diego later sent a warning to local media, warning parents that the image can indicate the presence of predators. It also issued a bulletin:
Gawker later reported that it had spoken to the San Luis Obispo Sheriff's Department, and that the department knew it was an "Internet joke",[3] despite the fact that they had referred to pedophiles adopting it as a mascot. Two local television stations, KSBY and KCOY-TV, passed on the warning to their viewers.[12] In Tulsa, Oklahoma, Sgt. John Adams of the Tulsa Police Department Child Exploitation Unit falsely told local television stations KOKI-TV and KOTV that the person wearing the costume was a registered sex offender, a claim which was later retracted.[14][15][16]
I respect/desire free speech. However, with anything, we should use common sense and consideration before publishing/speaking.Yes, facts needed to be made to the appropriate people and authorities but to print all the details was unnecessary and only more damaging and humiliating to the victim.
The point I am trying to make is that the security and freedom do not have to be a black and white topic. Kids need to be exposed to the threats of the world including the internet. However, it should be done with the level of maturity of the child. A good parent does not 100% block the world from the child; a good parent exposes the world to a child in a manner that will not harm a child but make the child stronger.
I laugh at you over protective parents. I have watched porn for many years and i have not changed or been screwed up from it. I turned out fine and my one friend who drinks a lot and does drugs had over protective parents. Give your child some freedom.
I need to disagree that this method monitors all network traffic in/out of you home. I simply logs the ip addresses which is not the same thing. There are legitimate sites that can be visited where my teen can still get into trouble. What my main interest is what data is being exchanged with host IP addresses. Is it an innocent chat with one of her friend or is the pedophile across town trying to set up a meeting at the mall. Do you see the important difference. I have been scouring the web looking for a solution but all I can find is network sniffers that record everything in a sort of cryptic raw format and you have to be really savy to interpret the data and what it means.
The upshot is that there ought to be no absolute rule on the relationship between attempt liability and a frustrating mistake. Not all attempts frustrated by mistake should be punishable, and not all mistaken assumptions that expressive material is unprotected should bar liability for attempts to commit a crime. The legitimacy of attempt liability should turn on its consequences for protected expression and the law that protects it. When, as here, a protected category of expression would inevitably be suppressed and its First Amendment safeguard left pointless, the Government has the burden to justify this damage to free speech. 2ff7e9595c
